PLAINTIFF NON-SUITED. (By Telesrapli.—Press Association.) WELLINGTON, Wednesday. An alleged pre-marriage contract by the husband to settle on her all the income from his investments was relied upon by Hinemoa Corelli Cliarlotta Richards in an action for specific performance or £1(1,000 damages against David Richards, retired University Professor, of Otago, in the Supreme Court, before Mr Justice Ostler. The plaintiff in evidence said that the understanding was that, even if she did not marry Richards, she was to get the whole of his money if she remained his friend. After hearing further evidence His Honour non-suited plaintiff on the ground that there was no evidence of a contract, and if there had been it was debarred by the Statute of Frauds, lie advised the parties to settle the claim for maintenance out of Court, and to avoid further lengthy litigation.
