DEFUNCT RACING CLUB.
SUES FOR SUBSCRIPTION. AX INTERESTING POINT. The question whether a person signing a list to become a member of a club before its incorporation ran be claimed as a member after incorporation was decided at Morrinsville before Mr J. H. Salmon, S.M. The action was one in which the liquidators of the Morrinsville Racing Club (Mr S. S. Allen) sued S. S. Bloomflcld (Mr E. McGregor) for two years' subscriptionsThe evidence showed that the club came into existence 4 J years ago,'and was incorporated. Prior to the incorporation defendant, among others, signed a list to become a member. The club got into difficulties at an early date owing to the inability to obtain a totalisator permit. Defendant had paid his first subscription prior to incorporation.
The. defence claimed the defendant was' not, a member of the club; as the officials had not sent defendant any notice of acceptance as a member. Under cross-examination defendant admitted having received notices of meetings, etc.
His Worship maintained that the the, contract was completed by the club offering- membership to those who signed the list, and the defendant, after receiving notices as a member, was estopped from denying membership. Judgment was given for the club for lb,; amount claimed, £2 2s, and costs £2 2s (id.
