—^ —__— NEW TRIAL ORDERED. By Telegraph.—Press Association. W EI,LINOTON, Monda y. The Court of Appeal gave judgment in the case Of King v. Hoscoc and Holland. The case was staled for the opinion of Hie Appeal Court by Mr Justice Reed. Hoscoc and Holland had been charged with theft, and the questions for the Court were as to the correctness of the direction given at the trial by the judge to the jury, and as to the meaning of the verdict. The Court was of opinion Hiat 'ho direction of Ihe jury was obviously wrong as being calculated to give a wrong impression as to the view they should take, of the onus of proof. The verdict of the jury, however, was not one of not guilty, as it did not negative an essential element, of the offence charged. The Court was of opinion that on the ground of misdirection lo the jury the verdict should be set aside and a new trial ordered at Hie next criminal sessions -in Wellington.
