Judgment lor plaintiff for £2O damages and an injunction to restrain defendants from trespassing on plaintiff's land was given by Mr Justice Cooper in the Supreme Court, Auckland, in the case of P. A. Cullen (Dr Bamford), of Kihikihi, farmer, against two Maoris, Rata Karaka and Aera Rewhi (Mr Inder), of Parawera. Plaintiff's case was that defendants and other Maoris repeatedly cut down his fence and used a path across his property to the main road, and he claimed £OS 10s damages and an injunction against trespass. The defence was that defendants had acquired a right-of-way across plaintiff's land by long usage, and also that their ancestors had given some of their land tor the right to use a path across plaintiff's property. His Honor, in giving judgment, said defendants now had a public road through their property, and must use that instead of trespassing on plaintiff's land.
