Tho Nautical Court found that the wreck of the Defiance at Kaipara arose from the ma-;ter somewhat imprudently standing in too close to the beach before tacking, and the vessel, being close-hauled and under small sail, had not sufficient way on to ensure her going round; also that the signalman in charge at the time was not Pufficiently experienced and competent to act as such. The court did not think it dosir.ble or justifiable to sugpeud the captain's certificate.
