AUCKLAND FRUIT SALES.

The following is a copy of the agreement entered into by Messrs Esam and Arthur and the Auckland Fruitgrowers' Union, to which the Waikato Fruitgrowers' Association is affiliated, for the sale of fruit of members of the Union : 1, That the firm of Esam and Arthur be and are hereby appointed sole agents for the Auckland Fruitgrowers' Union, 2. That the Agents shall on adjustment of sales of fruit sold on behalf of the Members of the Union pay the net pro* ceeds into the Agents' Bank Account entitled The Auckland Fruitgrowers' Union Trust Account, from which account payments shall be made. 1 3, Agents shall within one month of the signing of this agreement take steps to arrange for the cartage and wharfage of fruit from the wharf to Agents' stores, and to fix price per case, according to size as hereinafter mentioned providing such arrangements can be made to the satis* faction of the Executive of the Union and the Agents. Fruit delivered by rail* way to be charged tariff rates. '4. Agents to arrange is possible for carriers to deliver fruit within the city and suburbs at a fixed rate per case, or half case cost of cartage to bt paid to Agents before delivery, 5, All fruit or other produce shall be sold by the box, case, or sack, either to private buyers, dealers, or factories; no bulk to be broken. Where desired by mem* bers, the Agents shall forward or supervise the forwarding of fruit or other pro* duce to their agents in Southern ports, or to such other salesmen there as the grower may direct. 6, Buyers other than regular traders when purchasing by private sale and not at auction shall be charged a substantial advance on current wholesale rates. 7, Agents to offer Union fruit and produce by auction during the season, on Tuesdays and Fridays and such other day or days as Agents may see fit, such Union fruit and pr.oduoe to have precedence of other consignment of fruit and produce, but limited discretionary power is given to the auctioneer to vary these conditions if in his opinion sueh variation would be for the advantage of the members of the Union. Agents undertake to set aside a conspicuous and convenient position in the auction rooms for the display of Union fruit, as stated in their letter of applica tion for appointment. 8, Account sales of fruit sold during one week to be completed by the following Friday, and members returns to be posted unless they signify in writing to the Agents that they desire other mode of payment. 9, All members of the Union must have one distinct brand of their own a copy of which must be sent to the Agents, who will keep a register of such brand and Agents shall not sell the fruit of any member at the 5 per cent, commission who shall not keep to such brand for a Beason; and no member shall place the Union brand on any but teases of the standard capacity and dimensions, viz,, bushel cases, 2640 cubic inches.; half-cases, 1320 cubic inches; and grape cases, 4$ x 121 16, inside measurement, Memo: Dimension? for bushel caße 11 x 12 x 20 or 1{ x 14 x 26; half-bushel case, 11 x6x2o or x (14 xl3or 7 x 26); inside measurement. 10, The Union expect that all fruit sold in cases branded with the Union brand on coming from members will be of the class marked on the case viz, Extra, No. 1 No. 2 inferior or mothed, 11, The Agents are hereby empowered and instructed to deface the Union brand where placed on undersized cases and to report the matter to the Executive at once. 12, The Union empower the Agents to dispose of seriously mothed fruit to evaporator, pulping or jam factories when prices offered by same are fair \ value, The Union do not encourage the sending of such fruit for sale. The Agents shall report to the Executive the sending by members of badly infected fruit when not clearly marked as such. 13, Agents will be required to report to the Executive any systematically unfair packing on the part of. any member for them to take such steps as may seem desirable and Agents shall sell fruit so packed by auction on its merits, 14, All sales to be effected on the basis of cash and any credit giveu to be at Agents' own risk. 15, Agents' remuneration to be o per cent, commission on gross sales. Fruit and other produce forwarded to Southern Ports at the request of members or supervised in transhipment to be charged 2£ per cent, extra the per cent, to cover local and Southern commissions. Agents to bo responsible for payments of these shipments only when forwarded to their own representatives. Agents undertake to provide members with stamped addresses and printed advice notes and also undertake. to advise results of sales by first post for which the cost of postage only will be charged. All costs of printing to be paid by Agents. 1 16. Agents to 'supply secretaries of Union and affiliated associations regularly with information as to condition of PJhe markets. 17. This agreement to be in force for one year from the 19th of October 1894 notice to terminate such agreement on either side to be given three months prior to Ist of November 1895. Should however the arrangement now entered upon be found mutually satisfactory at its expiration an agreement for a further two years shall be made. Inability of Agents to meet their financial engagements shall at once justify the Union in cancelling this agreement.
