RESIDENT MAGISTRATE'S COURT, HAMILTON.
Tuesday, September 17, 1872. (Before W. N. Searancke, Esq., R.M., and T. S. Seddon, Esq., J.P.) 0. McKensie v. Potter —Wrongfully Impounding Cattle. Judgment deferred from 17tli instant. In tliis case, tlie Court ruled that the plaintiff should have communicated with the chairman of the East Hamilton Town Board that he wished to have the fences around Potter's property inspected ; instead of doing so, he called upon two individual members of the Board, who viewed the fences in company with plaintiff; but they did not disclose the purport of their visit, or that they came officially as members of the Board to the occupier who was at work at the time upon the property. About ten days after, the chairman and two members of the Board viewed the fences, when they were in good condition. The chairman disclosed the object of his visit to defendant previous to inspecting the fences. In giving judgment the Court desired it should be distinctly understood that in every case the party desiring to have fences examined must communicate with the Board through the chairman, when a quorum of the trustees must make the object of their visit known to the party in occupation previous to inspecting the fences. —Judgment for defendant, 10/-, and costs, 30/-.
