SPECIAL ORDER ACCEPTING SURRENDER AND GRANTING NEW LEASE. "foJOTICE is hereby given that at a SpeMeeting of the Wanganui Borough Council duly convened and held at the Council Chambers, St. Hill Street, Wanganui, on the twenty-seventh day of March, 1917. the following resolution (intended to operate as a Special Order) was duly passed: WHEREAS by Deed of Lease bearing date the twenty-eighth day of November 1901, and made between the Mayor, Councillors and Burgesses of the Borough of Wanganui (hereinafter called "the Borough") of the one part and THE SOUTHERN CROSS BISCUIT COMPANY LIMITED (hereinafter called "the Lessee") of the other part the land comprised and described in the said Deed of Lease being all that piece or parcel of land situate in the Town of Wanganui containing One (1) acre and Twenty-six decimal one (26.1) perches more or less being the Sections Numbers 2 and 4 on a plan of part of the Wanganui Town Belt deposited in the Deeds Registry Office at Wellington as Number 237 was demised and leased by the Borough to the Lessee for the term of forty-two years from and inclusive of t«he first day of May, 1901, at the yearly rental during the first twenty-one years of the said term of Twentv-iive pounds two shillings and sixpence (J25 : 2 : 6) and during the remaining twenty-one years thereof of Thirty-one, pounds eight shillings and one penny (,£3l : 8 : 1) AND WTiERJiAS the Lessee has requested the Borough to accept a Surrender of the said lease of t*ie said lands and to grant a new lease thereof to the Lessee in the manner for the term and upon the covenants conditions and provisions herinafter appearing NOW THEREFORE the Wanganui Borough Council in pursuance and exercise of the powers vested in it by The, Municipal Corporations Act 1908 and all other powers enabling it in this behalf DOTH HEREBY RESOLVE by way of Special Order:

1. To accept a. surrender of the said Dc<?d of ]>ease of the twenty-eighth day of November 1901 and to grant to the Lessee a new lease of the said lands comprised in the Raid lease. 2. The term of the said lease to be twentv-oue vears from the first day of June '1917.

;5. The rental to be paid in respect of the said lands shall be the sum of Sixtyseven pounds ten shillings (£67 : 10 : 0) per annum and such rental shall be paid half-vearly on the first day of December and the first day of June in each year of the said term.

4. The new lease shall contain a covenant for the granting of renewals of the said leaae in perjwtuity at an annual rental to be lixed by valuation of the full and improved ground rental of the said premises that ought to be payable during such new term without taking into consideration the value of any buildings or improvement*; then existing on Ihe demised premises for successive periods of twenty-one (21) years and such lease shall contain the same covenants mutatis mutandis as are contained in leases of the Town Belt of tho Borough of Wanganui now granted by the Wanganui Borough Council and such other covenants conditions and provisions as are contained in the said present lease to be surrendered as aforesaid or are authorised by the said Act and agreed to by the parties to the leaise. 5. The form of the said new lease and the covenants and provisions therein shall be settled by the Borough Solicitor.

6. The lessee shall pay all costs ami charges incurred in the preparation and advertising of this .Special Order and shall also pay all costs and cliargcs in connection with the preparation and execution of the said new lease.

The above Resolution will be submitted for confirmation at a special meeting of the Council to be held on Tuesday the 24th. day of April 1917 at 7.30 p.m. at the said Council Chambere. Dated this 28th day of March, 1917. G. MURC-H, Town Clerk.
