MAJOR CHARGE DISMISSED.

This morning the Magistrate gave his decision in the case in which Henry Gordon Barrington, a salesman for Inglis and Co., a Wellington motor firm, was charged with having been drunk while in charge of a motor car on August 19th. His Worship said that on the evidence he was satisfied accused was under the influence of liquor at 6 p.m., but he was impressed by the evidence of Dr. Cook that he "was sober at 9 p.m. The question then was, what state was lie in at the time the accident occurred. On the evidence that accused was fit to use the telephone after the accident and had helped to right the car, and also that Constable Johnson admitted he would not have arrested him for drunkenness, His Worship said lie was satisfied accused was not drunk when the accident, occurred. The charge of being drunk while in charge of the ear would be dismissed.
His Worship said that he_had power to amend the charge, and intended to alter the information against accused of having driven the car at a speed dangerous to the public safety. After consultation with his counsel, defendant pleaded guilty to the charge of excessive speed, and was fined £5 and costs.
