Al lhe prosecution was the sequel to a collision which occurred between accdsed's truck, containing a party or Public Works employees, and a lorry driven by James Richard Gore, farmer, Karamu, three of the occupants, Wihiam Aikuian, Henry Lewis 'Williams, and William Oliver J-ir- \ is. icceiving tatal injuries. In evidence Gore slated that he saw accused’s truck approaching on its extreme incorrect side. Seeing a collision was almost inevitable witness steered into the bank and applied the brakes. Grogan's truck, allbough ( sweiving at the last minute, struck witness’s vehicle. The police put in a statement by accused in which he stated that toe i camber of the road prevented bun from regaining the correct- side. Had ’ the condition of the road be«n reasonable, accused thought that he could base avoided the accident. Alter lengthy evidence, Giogan pleaded not guilty and was committed to the Supreme Court at Hamilton for . trial.
