Warden Burgess, in delivering judgment in a. case where, after a decree of forfeiture had been granted, applicant claimed to have repegged the ground by formally placing his hands on the existing pegs, stated that this was n0t...-sufficient to constitute proper marking out. New pegs required to bo put in. Their acquisition in the position of the previously existing pegs could- not be regarded as marking out. Tho Magistrate held that the claim had not been marked out according to law f,nd refused the application.
