NO CRIMINAL NEGLIGENCE
MOTOR TRUCK AND CAR COLLISION. Allen Burgess Carter was charged at the Otorohanga S.M. Court yesterday with negligently driving a motor lorry on the Otorohanga-Piron-gia road on 28th March 1928. A further charge of operating a motor vehicle without having the same equipped with a reflector or periscope, so arranged as to enable the driver to be aware (without turning his head) of the existence or approach of another vehicle on the right-hand side behind the driver.
The defendant pleaded not guilty in both casea
The case arose through a collision with a car driven and owned by Mr Kerrigan and the lorry of the defendant.
Constable Fry detailed the circumstances of the accident and his first interview with Mr Carter after the occurrence.
A. B. Carter stated that he was a carrier and brought cream from the Honikiwi district and was following his vocation on the day of the accident. Having broken his mirror on the 27th of March, he at once ordered another through the firm of Burrell and Son, who had some little trouble in filling the order. Mrs McDonald, who was a passenger with Carter, at the time of the impact, stated that she had not seen or heard any collision. His Worship, after hearing a large amount of evidence concluded by stating that there was no criminal negligence disclosed on the part of Carter and he would dismiss the first chai'ge against him, but would convict and fine him 20s and Court costs 18s on the second charge. • ■
