LEVEL CROSSING DANGERS
A NEW ASPECT. WELLINGTON. This Day. A point never previously raised in a New Zealand court as to whether a plaintiff who had disregarded his: statutory duty was deprived of action was mentioned before Mr Justice Salmond in the Supreme Court yesterday in the course of a legal argument. The case in question arose out ofa fatal collison between a motor lorry driven ii.v John Edward Canning, husband of suppliant, and Die north hound .Main Trunk express at Porirua. The plaintiff. Maud Barbara Canning, was awarded £IOOO damages by the jury when the case was previously before the Court. The principal question for determination by the Court was as to whether deceased had disobeyed the statute, the provisions of which said that the person driving a motor vehicle over a railway crossing must stop before coming into contact with Hie line. Tile question was also argued as to whether this deprived Mrs Canning of her right of action. After legal argument His Honour reserved decision.
