WARDEN'S.

Monday, 15th April, 1907.

(Before G. Cruickshank, Esq., Warden.)

Daniel O'Brien, jun. (Mr Crooke) : Alteration of water-race from Waipori River. — Withdrawn, a fresh application having been filed. Thos. O'Brien and Jos. Williams (Mr Crooke) : Alteration of water-race from Waipori River. — Withdrawn ; fresh application filed.

Tamaiti Gold Mining Co., Ltd. (Mr Crooke) : Reduction of workmen on claim. — The Minister of Mines having given his consent in this case the application was granted. Chas. Lappan (Mr Fletcher) : Dam and water-race of three heads at Rocky Creek, Waipori, and extended alluvial claim of four acres.— Mr Fletcher .explained that these applications had been adjourned from last Court day in order to give two parties, who were affected, notice. One of the parties had taken no heed of their notice, while the other, who was the bolder (under perpetual lease) of the land on which the dam was to be erected, had written to say that he offered no objection.'provided he received £12 compensation for 12 years. Counsel said applicant admitted that two acres would be affected, but, as only Is 3d per acre was being paid for it to the Crown, he considered the claim too high. He offered to accept the grant subject to any claim for compensation being decided at a future sitting. — In the absence of the title under which the land was held the Warden was uncertain of his power to grant the application fora dam, and it was decided to adjourn the three applications till the 13th May in order to give the objector an opportunity to forward his title, or be represented at the hearing. William Hurst (Mr Crooke) : Extended alluvial claim of two acres, Post Office Creek. — Granted.

Benjamin Bertenshaw (Mr Crooke) : Water-race at junction of Devils Creek and Deep Stream, Waipori, to divert 10 heads of water. — Granted. — Applicant was also granted a right for a dam below the junction of Devils Creek and Deep Stream.
