Madden, K.C.M.G., etc. Messrs Sander and Sons brought an action against a Eucalypti Distillery for passing off their goods as those of Sander and Sons' by such means as simulating Sander and Sons' get-up ; publishing medical reports made up on the merits of Sander and Sons' product ; publishing a partner's testimonial that their product is of equal quality ; publishing an incorrect statutory declaration, etc. His Honor when giving judgment said with regard to the GENUINE SANDER AND SONS'.. EUCALYPTI EXTRACT, , whenever an article is commended to the ' public by reason of its good quality, etc., it is not permissible to imitate any of its features. He restrained the defendants perpetually from doing so and ordered them to pay all costs.
