Labis and party's application for an extended claim was objected to by James Harris and party, who were already in possession of the ground. Mr. M'Coy appeared for applicants.
Mr. Copland, for Harris, objected to the application, contending that his client was already in lawful possession under the Goldfields Regulations of 1868. James Harris stated — I am the owner of this claim. Mr. Lewis represents me. The claim cost me L 250, irrtspective of wages. I was prevented from putting extra machinery on the ground, because Labis aud party jumped the ground.
By the Warden — I shall lose L 250, and aboutLLßl have paid for wages, if the decision is given against me. We have been offered L 335 for the claim and machinery.
By Mr. M'Coy — The machinery would be worth very little if it was removed from this particular claim.
W. D. Morrison affirmed — I knew this claim. I have seen the machinery. There is a large dam, wheel, and pump. I consider L4OO a low estimate for constructing a dam of that size. Mr. Harris instructed me to see about getting new piping, <fee. , for the better working of the claim.
By Mr. M'Coy — I am not a partner. [ always take the precaution of looking at the pegs, and seeing the claim properly out, if I have anythiug to do with it.
Mr. M'Coy, in support of the application, contended that it was a hardship on Harris to grant this application, and it would be an injustice to Labis to refuse it. The right of Lewis to the claim ceased when he failed to hold a miners' right. lie considered the opinion of the Delegates, now sitting in Dxmedin, coincided with this view, which was worthy of consideration.
Labis stated — When I marked the ground T found it falling in many places. I conld only find two pegs. I askedXewis if anybody worked the ground. He said not since April, excepting Colquhoun, who only damaged the ground. T then went and marked out a claim, and .applied for it on the 28th of April. I occupied the ground from the 27th of April' to the oth of May.
By Mr. Copland — Lewis showed me two pegs standing, a third one nearly down, and the fourth quite down. :
The Warden, after reviewing. .the evidence and commenting upon the remarks of Counsel, refused the application.,
