CLAIM £6OO AS SEQUEL TO DEATH OF A TROTTER.
FLORRIE HUON HIT BY CAR IN CITY.
The value of a trotting mare, Florrie Huon, injured in an accident and destroyed, was the subject of a case before Mr Justice Adams and a jury of twelve in the Supreme Court to-day. Frederick Martin, Christchurch, Press agent, and Maurice O’Connell, Tai Tapu, saddler, plaintiffs, owners of the mare* sued Maurice Kenrick Whale, Christchurch, clerk, defendant, for £6oo[ the value of the mare.
Plaintiffs alleged that on November 2, 1927, Whale drove a motor-car near the intersection of Fitzgerald Avenue and River Road, and collided with a gjg drawn by the mare and driven by Frank Needham, baker. It was alleged that the collision was caused by Whale’s negligence in failing to keep a proper lookout, in driving at an excessive and dangerous speed, and in driving the car negligently. While denying liability for the cause of action, Whale paid £IOO into Court, and claimed that it was sufficient to satisfy plaintiff’s claim. Mr Twyneham appeared for plaintiffs. and Mr Donnelly, with him Mr K. M. Gresson, for defendant. Mr Twyneham said that Whale admitted that the accident was caused by his negligence. The only issue was the value of the marc. Florrie Huon had as sire Wildwood Junior and as dam Alice Huon. Olive Huon, her full sister, had put up excellent performances on the trotting track. Florrie Huon had a pedigree from which firstclass trotting horses had been produced. (Proceeding.)
