ALLEGED CRUELTY.

[Per Pxikss Association.] DUNEDIN, Jan uary, ,28..,. A charge against Robert Vincent forhaving tortured a dog. at Brighton, on December 29, was dismissed by Mr Widdowson, S.M., this morning Vincent sustained a fall from' a cycle through the dog, and afterwards hacked its throat with a. penknife, then letting it escape. Further .evidence was called this morning-' Ri' Evans said " that after concussion of the brain ,a ,_man might act in an apparently rational manner yet quite automatically, and_ in :such oases, after a period of depression a period of exaltation might ; follow, when the victim might become violent. This evidence and the evidence of the man who drove accused to Green Island later, bore out the earlier testimony for the defence. 'Mr Widdowson, in dismissing the case, held that the Act was not committed while accused was of sound mind.
