The Divisional Court discharged the Magistrate's order for' the extradition of A, P.JPercival, formerly treasurer of Trinity College, Melbourne, o» a charge of embezzling y the College funds. The ground of the refusal of extradition was that the evidence was insufficient to show that the offence was punishable in Victoria with a year's imprisonment. ■
