£Per Press AssociAttos.] DUNEDIN, Sept. 18. ' The oats case in connection with the J. G Ward Farmers' Association came before Mr Justice Williams in Chambers in the Bhape of a summons in John Cornell and Co. v. the- Colonial Bank for directions as to the taking of accounts and making the inquiries directed by the judgment. The Sarge question in the summons was the question of -whether the 'bank was entitled to be treated as having paid £5000 to Connell and Co. in reduction of the liability under the judgment. On Dec. 31, 1895, the (Association drew a cheque on working account on the Bank of New Zealand, which lad taken over ths account en Nov. 18, and purchased a cable drafb or transfer. That was the act of the Association paying its debt to Connell and Co. The bank argued that that was equivalent to the payment by the Colonial Baitk to Connell of : part of the money for which it had. to account under the judgment ; further, it was contended that the bank was entitled to the amount as a just allowance for money which at was made responsible for. Mr Justice iWHEams made an order that the bank was not to be allowed credit for the £5000.
