(Before His Honor Mr Justice Johnston, and a special jury of twelve.) M'DONALD V. THE MANr>KVII,LE AND KANGIOKA ROAD BOARD. This case had been partially heard on July 24 and 25. Mr Wynn-Williams (with him Mr Gresson) appeared for the plaintiff; Mr Joynt appeared for the defendants. In conseqxiencq of Mr Barns, the Foreman of the Jury, not having returned from Auckland, his Honor, with the consent of learned counsel on both sides, allowed the case to go on with only eleven jurors. The case for the plaintiff was proceeded with.
