Patterson M'Led. Ihe case of J. P. Maitlund, Commissioner of Crown Lands, Otago, v. D. H. Mervyn was gone on with. The quo-.tion involved is whether the Crown has any remedy against a deforrcd payment selector by aotion fer an instalment of the purchnao money, and whether forfeiture is not the only reme iy under " Tho Land Act, 1877." The appeal is from tho decision of Mr Justice Williams, giving judgment upholding the demurrer to the first count of the plaintiff's claim. Mr F.'li. Chapman (Dunedin) appearod for the defendant in support of the domurror ; Mr Haggitt (with him Mr Stoat) for the plaintiff in support of tho declaration. Ihe cp.so will probably finish to-morrow.
