' twentyman v. tvai.ton xhd akothsk. , His Honor delivered judgment In this caso a motion was mad 3 some weeks ago on tho part of tho defendants to dissolve a provisional injunction, by which they were in effect restrained from dealing with or applying to their use the estate of Thomas Tennant, Jo bankrupt, which had been assigned to them by a bill of sale, in satisfaction of a debt owing to them by the bankrupt. Tho case come on for argument on demurrer, In the course of which it wa9 contended, mainly, that tho bankruptcy could not bavo relation back to the execution of the bill of sale. His Honor orerruled the demurrer, with costs ; defendants having leave to plead on the usual terms as to costs, otherwise judgment for the plaintiff. As to tho motion to dissolve the injunction, his Honor said it appeared to him jthat tho plaintiff's rights might bo seriously .endangered were he to dissolve tho injunction. !llc must therefore refuse the motion, with :cost«. Mr Qarrick obtained ten days' time to con'aider whether his clients would plead. I Dr Foster is counsel for tho plaintiff.
