IN DIVORCE.
FISHER V. FISHER. (Press Association.' CHRISTCHURCH, April 5. Mr Justice Reed, sitting in divorce in the 'Supreme Court, had before him the rase’of F. M. B. Fisher, o£ London, petitioner, v. Ethel Alice Fisher, of Londo,n, an application for a time to he fixed for the return of respondent’s answer, and for a. commission to take petitioner’s evidence. Counsel -aid petitioner’s affidavit stated the marriage took place on December 22nd., 1899, at St. Luke’s Anglican Church. There were two children of the marriage, and the parties lived at Christchurch, and other parts of the Dominion.
Owing to incompatibility of temper they had not lived happily together since April. 1915. When Fisher left New Zealand Mrs Fisher, he believed. was !:i receipt of a private income of £SOO a year. In 1921, Mrs Fisher arrived in England and the parties agreed to live apart. Counsel said the ground of the petition was separation by mutual consent. An order was granted, but the .judge said lie would have to make a memorandum imposing terms.
