Charged with negligent driving so as to cause the death of Donald Derby Flynn (21), Mervyn Halsey Woolven (23) car salesman was found not guilty in the Supreme Court. Mr Justice Blair refused the Crown Prosecutor (Mr H. T. Gillies) permission to use as evidence experiments he had made on the scene with a constable with reference to visibility. Mr Gillies was not entitled to give any evidence whatever. Referring to the final summing up of the Crown, His Honour said he would not like to see any man convicted on guess work.
