ALLEGED BREACH OF AGREEMENT
DISPUTE WITH WHEAT BOARD CHRISTCHURCH, December 11. The question whether or not there had been a breach of an agreement to store wheat was argued before Mr Justice Ostler in the Supreme Court this morning. A claim for wheat supplied to an Ashburton merchant was admitted, and the case turned on a counter- ! claim, alleging that an agreement with defendant had been broken, j Plaintiff was the New Zealand 1 Wheat Growers’ Co-operative Assocla- | tion, Ltd., carrying on business as a ! wheat pool, and otherwise. H. L. Barker, of Ashburton, merchant, was ; the defendant. The statement of claim set out that plaintiff supplied to defendant 1473 sacks of wheat at a price amounting i • the defendant a balance of £444 The amount of £444 was claimed, together with interest at 5 per cent., from June 21, 1932, to the date of judgment. In I the counter-claim, defendant claimed : £B4l. or in the alternative £675 and the j costs of the action. Alter hearing the evidence, his 1 Honour gave Judgment for the Assocla- ! Lion on the claim, with costs. The | counter-claim failed.
