JUDGMENT DELIVERED WELLINGTON, December 8. The Court of Appeal this morning delivered judgment in the case Solomon versus H.M. the King, which was heard on October 12 lasThe Court gave judgment in favour of the appellant, allowing the appeal with costs in the Court cf Appeal and Supreme Court. Sir Michael Myers, in a lengthy judgment, said the task of the Court WuS to construe an agreement which had been executed between the parties, and he himself was satisfied that the agreement was one for service, and that the men were servants and not independent contractors. Mr Justice Ostler and Mr Justice Smith, in independent judgments, also held the appellant to be a s. vant, but Mr Justice MacGregor differed from the other members of the Court, and upheld the judgment of Mr Justice Kennedy, which was appealed from. In the case of Lysnar versus the National Bank, the Court gave Lysnar final leave to appeal to the Privy Council. ?
