SUPREME COURT.
TIMARU SESSIONS. (Before His Honour Mr Justice McGregor.) The quarterly session of the Supreme Court in Timaru opened on Monday. Two civil cases only were set down for hearing, but only one is to be proceeded with. Non-Suit Entered. The first case called was that in which Alexander Ralph Heenan and another claimed from the Caroline Co-operative Dairy Co., Ltd., £750 general damages, on behalf of a widow • />r the death of her husband as a I result of a motor collision. Mr A. D. Mcßae appeared for plaintiffs, and Mr C. S. Thomas, of Christchurch, for the defendant company. Mr Mcßae said that circumstances had arisen which rendered it impossible for the plaintiffs to be in attend- : ance, and on their behalf he elected I to be non-suited. Costs had been ar- | ranged between the parties. | His Honour entered the non-suit, with costs £7O/4/3. Case Adjourned. j A case in which James Melton is j claiming from Arthur William Barnett £8 special damages in respect of al- | leged losses through defendant making a rough drain on his property, I thereby causing drainage and storm | water to flood plaintiff’s property, was j adjourned until to-day. Bankruptcy. ! A discharge from bankruptcy was j granted Samuel R. Bryan, farmer, of Hinds. Removed to Christchurch. C. Taylor and Co., Ltd., of ChristI church, proceeded against Henry Hulj liriay, dyer, of Dunedin, on a motion for an interim injunction restraining defendant from using the name | “Taylor’s” in connection with a dyeI ing and cleaning business in Timaru | On the motion of Mr G. H. R. Ulrich j the case was adjourned to Christchurch, where the evidence is to be heard.
