SEQUEL TO LYNCHING
INDICTMENT OF AMERICANS. United Press Association—By Electric Telegraph—Copyright (Received January 27, 5.5 p.m.) HONOLULU. January 26. An indictment in the second degree of murder was voted against Mrs Fortescue, Lieutenant Massie. two naval enlisted men, Albert Jones and Ed • mond Lord, after the grand jury deliberated for ten hours. The arraignment date has not been set. This action removes the possibility of the death sentence, as the maximum penalty for this offence is life imprisonment, and the minimum of 20 years. It also makes it possible for the Navy to assume jurisdiction of all except Mrs Fortescue, according to a “gentleman’s agreement,” with the local authorities providing for the Navy having jurisdiction over Navy personnel in cases, not involving capital punishment. There will be a conference to-night on this subject. Mrs Fortescue, being a civilian, must submit to civilian trial. The defence will move on Wednesday to quash the indictment on the ground that the Court coerced the grand jury.
