YEAR-OLD BURGLARIES.
CLAUSEN CHARGED. COMMITTED FOR TRIAL. William Necular Clausen, arrested last week by Detective Faliey, was arraigned before Mr V. G-. Day, S.M., in the Magistrate's Court yesterday, on a series of charges. Accused, defended by Mr Emslie, pleaded not guilty to stealing, on or about April 22nd, 1910, one bicycle, valued at £lO, the property of Daniel Cosgrove, and ■ also to two charges of breaking and entering the rcsideiuo of l Mc]villo Gray, and stealing therefrom, several articles, valued at £9, and a number of cheques and postal notes, one offence being committed on March 19th, and another on April 12th, 1910. Sub-Inspector Phair said ho would not make any opening remarks but simply call the evidence. THE BICYCLE CASE. I'Yoin the evidence given by Daniel Cosgrovo, tho owner of the stolen bicycle } it appears that-, on April ' 22nd of last year, Cosgrove left tho bicycle at tho rear of his dwelling place in Pearson Street early in the evening, and, on going out at about 8.45 p.m., found the machine gone. Cosgrovo did not give Clausen permission to take the bicycle. He identified the bicycle produced in Court as his property, although it was iu much worse condition than wjieu it was taken. Constable McGregor gave evidence regarding the arrest of tho accused at Oamaru on August 7th. Witness had taken the bicycle from Elderslle as well as accused's swag. The night prior to his arrest, accused called at the Oamaru police station and asked for his property. When arrested, Clausen denied having stolen the bicycle, ! stating that he had bought it in Oamaru, but had lost the receipt lie received on paying for the same. Accused also said that when he was leaving Tiniaru, he met a man on the road between Makikihi and Studliolmo, and bought the bicycle, and the swa-r rrom this man with £7 10s, given accused bv a friend in Timaru. Accused reserved his defence and was committed to tho Supreme' Court ior trial. BREAKING AND ENTERING. Accused pleaded.not guilty to both charges of breaking and entering the premises of Melville Gray Margaret Maraud, housekeeper for Mr Gray at the time of the burglaries, and for three years previous, remembered March 19th, the date of the first hurglnry. On that night, witness and Mr Gray retired at about the same tune, and witness saw that the house was properly secured. A French ; TO FARMERS FOR SPRING SOWING.
window-, on the verandah of the house, was always kept open. She. heard no noise through tho night, and roso at 7.30 a.m. next day. On the fence opposite the verandah she saw an article of Mr Gray's underclothing;, and some articles on tho lairn. On witness and Mr Gray making a. search', several articles, all those named in the charge sheet, were found missing. Tho clothing in Court was tho clothing stolen. She was certain of this,. for. £ho identified the clothing by mends alio hud made, and by the way the buttons were sewn on. .Witness also remembered tho 12th of April, when the house was entered by tho French window leading to Mr Gray's room. On that_ night, several articles wore stolen, including clothing produced in Court. Constable McGregor said that accused said when arrested that ho bought the swag from tho same man he bought tile bicycle from. Detective Faliey said ho arrested accused on tho breaking and entering charges, on August 11th. Accused said tho clothes produced were in the swag when ho "bought it. Ho left Timaru on a Friday, and bought the bicycle and the swag from a man on tho road the following Sunday. On Friday, October 21st, 1910, "accused was missing from his home, and, two days later, Cosgrove's bicycle was reported missing.
His Worship held that a prima face case was established. Accused reserved his defence, and was committed to the Supreme Court for trial.
Bail was allowed in one surety of £l5O.
