RESIDENT MAGISTRATE'S COURT.
TlMAßU—Friday, July 10. (Before B. Woollcombe, Esq., E.M.) DRUNK AND DISORDERLY, AND WlLnjli DESTRUCTION OP PROPERTY. Patrick Harkin was charged with the above offences. The first offence wa3 proved upon tho evidenceof Inspector Pender, Sergeant O'Connor and Constable Macdonald. The following evidence wa» taken m reference to tbe second charge. Thomas Price, photographer, Timaru, deposed : About half-past seven o'clock last night, when opposite Suttfr, Taylor, and Co's I heard a smash of glass and I went over the road to see what was the matter, and I saw the defendant struggling out of a window' as though he had fallen m. I saw him stagger up the street. Sergeant O'Connor camo up and I told him of the fact and he went up tho street I pointed defendant out ts the man who broke the window. Sergeant O'Connor: About half-past seven o'clock I heard a smash of glass and went m the direction of the noise. I met Mr Price and he told me that the man who did it had just passed up the street, and we went up and found the defendant lying on the road. When brought to the light Mr Price identified the man. Defendant offered to pay for the damage, saying he had money. James Hutcheson Sutter: Tho cost of the window is 42s altogether. Defendant was adjudged to pay £6 15s m all, including the cost of the window. The fine was paid. . : OBTAINING- MONEY UNDEE FALSE PBBTENCE3. Daniel Egan was charged with passing a valueless check at Waimate on the 6th July. It appeared that the defendant had given a cheque on tho Union Bank of Australia, Timaru, for more than he had lying to his credit. His Worship said that giving a valueless cheque was not a crime unlesß it could bo proved that tho person giving it knew it wa» valueless. Inspector Pender said he did not think ho could prove that, but he had known the defendant a long time, and it was an old dodgo of his. Thero had beon several convictions against the man. Ho was going about from place to place taking poor people m. ■ His Worship said as there was no evidence he must dismiss the case. ■ : !
