POLICE COURT.
At the Police. Court yesterday, before H.. Eyre. Kenny, Esq., S.M;, Henry Gardiner was charged with using indecent language in a public .place, to. 'wit, Haven street, on the Bth insfc. - Mr Clendon appeared for.the,defend- . ant; arid said he would plead guilty. The . .defendant was a very respectable young who had been a plumber and ...';eh«ineer and was-now mining ,at the ' ;.Thames. He was married, anclChad four ' children. Onthe evening of tlic-8(;h inst. he was very drunk, and consequently had .no knowledge of what took place, This was the first time he had been.chavged with :any offence,, and he bore a very, good,character. In support of this . statement Mr'Clendon rpad lhe following 'letter' from Mr Jay Ha wkes. I. ' have'knoWii .Henry ; . His \Worship said that under "The Police Offences Act, 1884," there was do option of a fine for using profane, indecent, or obscene language in a public place, .. However, as the defendant bore a good character, he did not wish to send him to gaol. Under the circumstances a conviction would be recorded against the defendant, and he would order him to come up for sentence when called upon. By taking this course, the defendant would be practically free, as he would not be called upon as long as he behaved himself. however, he was again convicted of a similar offence, he . would also be liable to punishment on the present Conviction.
