TO-DAY’S PROCEEDINGS, (Before the Chief Justice, Sir Robert Stout.) . LAURENT t. M'GINTY. Addresses of counsel and the judge’s summing up of the evidencs in the ease of XI. E. Laurent (Mr. O. H. Weston) v. Edward M'Ginty (Mr. A. H. Johnstone) occupied the Supreme Court from 10 o’clock this morning until after noon. The jury retired at 12.10 to consider the case on the following issues: (1) Did the plaintiff lease to the defendant two racing mares by the agreement set out (this was admitted); (2) did plaintiff and defendant agree to rescind tho contract and, if so when; (3) were the horses when leased fit for racing; (4 did Haversack become lama because of an injury suffered by hep before January 11, 1919; (6) did Hav* ersack become, through lameness, permanently unfit for racing; (6) what damages, if any, is the plaintif en* titled to recover? COLSON w. WOOLDRIDGE. DAMAGES OF £IOOO- CLAIMED. ADJOURNMENT TO SATURDAY. Ingram A. Colson (Mr. A. H. Johnstone) proceeded against Ebenezer. Wooldridge (Mr. A. A. Bennett) to recover £IOOO as compensation for in* juries received through a car driven ty defendant’s employe© striking plaintiff while on the Waiwakaiho Bridge at Fitzroy on March 19, 1919. Mr. Bennett submitted that the case was not ripe for trial because an . amended statement of claim had been filed just prior to the session, and defendant was entitled to a proper in- * terval within which to file ah amended statement of defence. He desired an opportunity of obtaining evidence to rebut the allegation of negligence on a new ground. Mr. Johnstone said that if his friend would be genuinely embarrassed by having to proceed he could not object to an adjournment. The caso was adjourned until Satuhday ’ BANKRUPTCY. The Chief Justice has intimated that he will deal with all bankruptcy matters at 9.30 on Friday morning.
