Goodwin Sc Co., of New York, the manufacturers of the OLD JUDGE CIGARETTES, instructed their agent in Auckland, Mr Henry E. Partridge, to take proceedings for the infringement of the Old Judge trade mark. As the result of such proceedings, the following older has been made by the Bupreme Court :—: — IN THE BUPBEME COURT OF NEW ZEALAND, NORTHERN DISTRICT. Between Charles G. Emery, of New York» trading as " Goodwin & C 0.," plaintiff, and Franz Bcherff and Others, of Auckland, trading rs " The Auckland Tobacco Company, defendants. Wednesday, the 24th day of August, 1887. Upon reading the affidavit of Heary Edward Partridge, filed herein, and the Plaintiffs statement of claim, and upon hearing counsel for the Plaintiff and defendants respectively, and by consent, it is ordered that a Writ ot Injunction do inane in this action restraining the Defendants, their servants, agents, or workmen from selling, advertising, or exposing for sale, or producing to be sold, any cigarettes being wrapped up or enclosed in labels, or having printed, lithographed, or stamped thereon the words, devices, marks, or symbols of the Plaintiff as in the Plaintiff's statement of claim mentioned, or any other wrapper, or labels, words, devices, marks, or symbols so contrived or expressed as by colourable imitation or otherwise to re* present the trade mark, wrappers, or labels of the Plaintiff, or to represent, or lead to the belief that the cigarettes manufactured and sold by the defendants are tbe cigarettes manufactured and sold by the plaintiff. And it is further ordered, that the Defendants do pay to the Plaintiff the enm of Fifteen Pounds Fifteen Shillings as and for his costs of this motion and incidental thereto. By the Conrt, (L.8.)
