(Before His Honor Mr Justice Johnston.) His Honor took his seat at 10 a.m, IN BANCO.

National Bank v. Craraond’s Trustees.—Mr G. Harper for plaintiff; Mr Joynt for defendants. —Mr Harper applied tor a new trial during the present session, before a special jury, and also a change of venue to Christchurch. — Argument was adjourned by consent to Saturday, Saunders v. Cabot.—This case, which was set down for hearing on Monday, was adjourned till Tuesday, on the application of Mr Joynt, CIVIL CASE. Grain Agency and Mercantile Company of New Zealand v. Alex. Proctor —Claim, £B7 8s 4d. —Mr White for plaintiff Company ; Mr Tosswill for defendant. This was a claim for loss sustained on a quantity of wheat shipped Home by the plaintiffs for the defendant.

Mr Tosswill and Mr White both addressed the Court at some length, and after a brief summing up by His Honor, judgment was given for £BS 16s Id. YESTERDAY. Miles, Archer and Co, v. Dennis Doare and wife—Claim £935 7s sd, balance of account (new trial). Messrs White, Smithson and Raymond, instructed by Messrs Harper and Co., for plaintiffs, Messrs Joynt and Hamersley, instructed by Messrs Sievwright and Stout, for defendants, On the case being called, Mr Joynt informed His Honor that the defendants had not sufficient time to reduce the special jury list, and were not therefore prepared to go on with the case. His Honor ruled that the proceedings must lapse. The Court then adjourned until Tuesday, when the case Saunders v. Cabot will be heard.
