Temuka—Wednesday, June 10, 1885.

[Before S. D. Barker, and D. Inwood, Esqs., J.P.'s. TRESPASS.

Mrs Swinton and P. McCaskill were fined 10s each for allowing cattle belonging to them to wander on the railway, civil cases. P. Coira v. D. Quarry—Claim JBB 3s. Judgment summons. Ordered to pay at the rate of 10s per week. Siegert and Fauvel v. S. SmithClaim £4 6b 3d.

Judgment by default for amount claimed and costs. J. W. Velvin v. J. H. EdmondsClaim £l2 12s 4d.

Orlando Matthews v. T. Foley— Claim £4, for services of a horse, Mr Aspinall appeared for defendant. This was a case adjourned from the previous Court day in order to produca the groom who led the horse. The groom stated that be agreed with the defendant. He came around on trial but Foley was not at home.

The defendant stated that when he agreed with the groom he promised to come round three times after New Year and that on that ground he gave him the mare.

J. Breen also stated that the groom had promised to come around three times in the New Year.

Judgment for the amount claimed and costs, to be paid at the rate of lOi per week. DISOBEYING A. SUBPOENA, Swan, the groom iu the above case was then charged on remand with having disobeyed a subpoena of the Court to attend to give evidence last Court day. Mr Raymond appeared for the accused, and called Swan, who stated that he was only subposnaed at 4 p.m. on Tuesday ; that then he was engaged in taking horses to the Waimate Steeplechase, and that he could not come. The Court, after having heard Mr Raymond, said the defendant must understand that he made himself liable to a penalty not exceeding £lO, but owing to the circumstances of the case he would be discharged. The Court then rose.
