SYDNEY NEWSPAPERS APOLOGISE.
“SHARK ARM” CASE LITIGATION. By Telegraph—Press Assn.—Copyright. Rec. 8.25 p.m. Sydney, June 21. Apologies for the publication recently in the Telegraph and the Sun of certain matter bearing on the death of Reginald Holmes, the witness in the James Smith inquiry who was murdered on June 11, for which these newspapers were cited for contempt of court, were made on behalf of the newspapers before Mr. Justice Haise Rogers in the New South Wales Supreme Court to-day. Addressing the. Court, Mr. Clive Evatt, counsel for Patrick Brady, who is charged with the murder of Smith, contended there had been, an attempt to connect in some fashion the death of Holmes with the alleged disappearance of James Smith.
Mr. Justice Rogers reserved his decision. As to ' the penalty he referred to the offence of prejudicing the question by referring to the death of Smith by assuming he was dead (which was a matter of controversy) and by stating that his death was due to murder. Patrick Brady, aged 42, a shearer, appeared in the Central Court to-day on remand on a charge that on May 12 he forged a cheque for £9B 10s on the Commercial Banking Company of Sydney with intent to defraud. In applying for a further adjournment the prosecution said Brady wa; at present concerned in a matter before another court. The defence agreed to the application, and Brady was remanded to July 23. Bail of £3OO was allowed.
