INADEQUATE WATCH KEPT

WELLINGTON DRIVER CONVICTED.

Arising out of a level crossing accident at Davis Street on May 2, Archibald Walker, driver of the car that was struck, was charged with attempting to cross the track when the line was not clear and with failing to keep a vigilant look-out. Both Walker and his wife were injured and the car was considerably damaged. Walker pleaded not guilty.

His explanation was that he heard the whistle of what he took to be a shunting train. When almost on the line he heard another whistle, but he saw the train that struck him too late.

Mr. E. Page, S-M., convicted Walker, saying that it seemed to him that the engine must have been in view of Walker had he. kept an adequate look-out. In view of the fact that Walker had already suffered considerable loss it was not a case for a heavy penalty, and he ordered the payment of costs, £2 Ils.
