AN APPEAL .FAILS. By Telegraph.—Press Association. Auckland, Last Night. Mr. Justice Herdman gave his decision to-day on the appeal by Charles Mcreon against the judgment of the magistrate who convicted him on a charge of using an unregistered motor-car. Appellant is a motor importer, does a large business in motor-cycles and keeps on the premises cars specially used for demonstration purposes. One of these cars was the subject of the present proceeding's. He used the car for a fortnight to transport him about the country on his business. The question was: Did the words “only for the purposes of sale” mean “only for the purpose of selling othei' cars.” His Honour did not think it was intended that such a wide interpretation should be given to the phrase. To so construe the section would let loose on the roads a fleet of cars which had escaped the licensing and registration provisions of section 3 of the Statute, a consequence which could never have been intended. He upheld the magistrate’s judgment, and dismissed the appeal with costs.
