ALLEGED PERJURY.
JURY FAILS TO AGREE. NEW TRIAL ORDERED. By Teleeraph.—Press A»socl»tlon. Palmerston N., Last Night. The jury failed to agree in the case of alleged perjury against Frederick Spencer Easton, and Judge Chapman ordered another trial at Wanganui on the [ 23th Inst. For the defence Easton deposed that Wright had won £3OO with the horse Stevens, for which he had given a cheque for £2OO. Easton asked several times for payment, but Wright eaid he was pushed, so he let hiui carry on. When Wright was disqualified Stevens was in full training, and this discounted the story that the hor&e had been turned tint in the cemetery paddock as deposed to by witnesses. He had sworn that the horse was not brought back to his place from Wright, not that tie was never back on the Moutoa estate after the sale to Wright. He could not swear to having seen a receipt entitling Trask to take over the horse. He had no recollection of such a lease, or ,tbat he had made out a lease to Trask until he wired to the racing authorities at Christchurch after the hearing of tha claim for £2OO in the Magistrate's. Court.. He had never seen a racing calendar in his life uutil one was produced in court that day. Under cross-examination he said that his memory had failed after he had suffered from influenza. Asked several questions about his transactions on the turf, he replied: "After what has happened before this court on thU terrible charge, and from a mountain that his grown out of a molehill, I don't know what to say." Two doctors were called, who testified that influenza had in dome eases a serious effect on the memory, and three leading business men testified •) tt> Easton's good character.' a The accused was admitted to ball.
