CLAIM FOR DAMAGES

A NGAHINEPOURI CASE. A dispute oyer a motor vehicle supplied for farm purposes but returned to the vendor when it was found to be unsuitable was heard by Mr W. H. Freeman, S.M., in the Magistrate’s Court, Hamilton, on Friday. Plaintiff was Winger and Company, motor dealers, Hamilton (Mr J. C. Taylor), and defendant was John M. McWhannell, farmer, of Ngahinepouri (Mr N. S. Johnson). The plaintiff company claimed £6 18s 2d special damages and £5 general damages. The deal was allegedly effected on November 20, 1940, delivery of the vehicle being made on November 22. The evidence showed that the vehicle was altered at plaintiff’s garage, and then delivered to the farm. McWhannell used it, but would not thereafter complete the transaction. The certificate of registration had been issued in defendant’s name. McWhannell returned the truck and contended that an assurance had been given that the vehicle, a converted car, would carry equipment for haymaking. Plaintiff claimed that the sale was a snap one, and no warranty had been given. A trial was not stipulated or agreed on. Judgment was given for the plaintiff company for £4 8s 2d.
