pive reasons why a private Trustee may prove unsatisfactory H While it may be considered a compliment to a lifelong friend to name him as a trustee, the compliment is a doubtful one. It throws a heavy burden of legal obligations upon the trustee, which, unless met with a full knowledge of the law, may innocently result in a breach of the trust. Moreover, the appointment of a private trustee may prove Ineffective for one or more of the following reasons : I. If he remains out of New Zealand for over 12 months a new appointment is necessary; 2. He may refuse to act; 3. He may be incapable of acting; «4. He may be unfit to act; 5.
