pive reasons why a private Trustee may prove unsatisfactory H While it may be considered a compliment to a lifelong friend to name him as a trustee, the compliment is a doubtful one. It throws a heavy burden of legal obligations upon the trustee, which, unless met with a full knowledge of the law, may innocently result in a breach of the trust. Moreover, the appointment of a private trustee may prove Ineffective for one or more of the following reasons : I. If he remains out of New Zealand for over 12 months a new appointment is necessary; 2. He may refuse to act; 3. He may be incapable of acting; «4. He may be unfit to act; 5. He may predecease the Testator. in the event of any one of these contingencies, the estate may be burdened with considerable expense in appointing a new trustee, who may be unacquainted with the details of the estate and a stranger to the beneficiaries. guards & GUIDES It is better, it is safer, to appoint the Guardian Trust and ensure perpetual fidelity to the terms of your Will, strict accountability by law for all its acts, and adequate financial resources to nurse assets when needed.
