ACTION FOR RETURN OF GEAR PLAINTIFF AWARDED £6B An echo of the recent voyage of the cutter Maroro from Auckland to Samoa was heard yesterday, when & claim was brought in the Magistrate's Court by A. Colins (Mr. Bryce Hart) against Peter* Smith and L. Pitcher (Mr. Jacobsen). Plaintiff claimed for the return of chattels left on board the Maroro, the boat having been leased with an option of purchase from defendants. Plaintiff, who had put certain chattels aboard the boat, found he could not raise the £IOO deposit required, and the boat had been offered to another buyer. Plaintiff’s solicitor had written to defendants and enclosed a list of the chattels. A reply had been received asking plaintiff to state tiy value of the gear in terms of cash. Mr. W. R. McKean, S.M., orderei the return of the chattels set out in the statement of claim, or, alternatively, the payment of their value, £65. An additional claim for £35 for general damages was considered excessive, the magistrate allowing £3 as a concession for inconvenience caused the plaintiff by not being able to obtain the chattels. On a counter-claim for rent the defendants produced an unstamped .agreement. As they declined to pay into court the requisite amount to make the document receivable in evidence, the claim was non-suited.
