’ DAMAGES AGAINST DRIVER From Our Own Correspondent » MARTON, Friday. 1 An interesting and unusual civil l action was lieard in the Mar ton Court yesterday as a sequel to a. mishap which occurred near Hulls in June last, 1 in which a motor lorry belonging to • tho Marton Sash. Door and Timber Company dashed into a mob of sheep, killing outright several of the animals L and fatally injuring others. - The owner of the sheep, Stewart McKenzie, of Bulls, claimed from the company the sum of £36, being £26, the value of 13 sheep which were 1 killed, and £lO general damages for L the effect which the mishap had on the ■ remainder of the sheep. Mr. H. R. Cooper (Palmerston ■ North) appeared for plaitiff and Mr. .T. ' R. L. Stanford (Marton) for defend- ; ants. Evidence went to show that the mishap occurred on the main road | between Bulls and Greatford, in the ’ early evening of June 25 last. Plaintiff maintained that the time was 4.45 p.m., ' but the driver of the lorry declared that it was after 5 o'clock, and there--1 fore quite dark. Tho defence was that there was negligence on the part of the drovers, who should have ’ carried lanterns. The magistrate, Mr. R. M. "Watson, : S.M., said that ho did not consider - that it was dark at the time, and at ' all events it was not laid down by law that lanterns should be carried. JudgI ment would be for plaintiff for the full | amount claimed.
