LIBEL ACTION
NEW TRIAL ORDERED. (United Press Assn.—By Telegraph—Copyright.) London, March 22. The Court of Appeal-has allowed the appeal of the defendants in the Chapman case and a new trial has been ordered regarding the publication by the news agencies and The Times. The alleged doping of Don Pat in .September of last year was the basis of an action brought by a well-known trainer, Charles Chapman, against Lord Rosebery, Lord Ellesmere and the Earl of Harewood, stewards of the Jockey Club, Weatherby and Sons, publishers of the Racing Calendar, and the proprietors of The Times for libel in publishing the stewards’ decision warning off Chapman from Newmarket and disqualifying the horse. Defendants pleaded privilege and justification. Counsel contended that they had never said Chapman had doped the horse. Evidence was given that the plaintiff had offered £5OO reward and had employed a private detective to discover the doper, but had failed. The jury found that the words meant that Chapman was a party to the doping and returned a verdict granting £13,000 damages against the stewards and Weatherby’s and a further £3OOO against all the defendants. A stay of execution was granted.
