TlMAßU— Tuesday, 22st Jan.

(Before C. A. Wray, Esq., it.M.) POLICE CASES. A first offender was fined ss. J, Fanning was fined 40s and 6s cab hire, for being intoxicated whilst in charge of a team of horses, in default 14s days. CIAIL CASES. Judgment by default was given in the following cases; —L. and P. Hartnett v. J. Mulcahy £3 10s, costs Gd ; K, McLennan v. J. Lukoy, £3l 5s sd, costs £1 lls ; R. Bonn v. W, Powell, £1 4s 6d ; Drummond and Glasson v. W. Wills £ t Ids ; same v. T. J. Kennedy £1 10s ; J. Hill and Co v. J. Gould £3 8s sd. The suit of J. Downes v. levels Road Board, claim £25 for loss of a mare alleged to have been through badness of a road on The Brothers, was further adjourned for a fortnight at defendants’ request. J. Howey v. W. Shepherd, claim £6 2s 3d for goods supplied in 1884. Defendant disputed the claim on the ground that he had gone through the Court since part of the goods were got, and the rest had been over-p vid for by contras.

Plaintiff asserted that defendant’s bankruptcy did not affect his claim, as Mrs Shepherd undertook to bo responsible, and the goods were charged to her. Defendant denied that Mrs Shepherd had made such an agreement. Plaintiff pointed out that defendant had not filed any declaration of insolvency, nor a set-off to the contras referred to. On defendant’s assertion of his bankruptcy and plaintiff’s statement regarding the liability, bis Worship told the latter he had sued the wrong person, and a non-suit was recorded.
