SIR O. MOSLEY’S CLAIM NEWSPAPER SUED (Klee. Tel. Copyright—United Press Assn.) (Received Nov. 6,2 p.m.) LONDON, Nov. 5 V Mucli interest is being taken in Sir Oswald Mosley’s libel claim against the newspaper Star, which is being heard by the Chief .Justice and a, special jury, arising from a public debate last year between Sir Oswald Mosley and Mr. James Maxi on. The action is based on a section ol a leader stating: ‘‘Sir Oswald Mosley warned Air Maxton that he and his Fascists would be ready to take over the Government with the aid of machine guns when the moment, arrived. Mr. Tom Maim was recently thrown into prison on a mere suspicion that he might say something ten times less provocative than Sir Oswald Mosley’s words.” The defence is that the words arc substantially true and fair comment. Sir i’utriek Hastings, for Sir Oswald Mosley, pleaded that tho words meant that tlie plaintiff was prepared to take over the Government by force, and had said something worse than what -Maim was imprisoned for.
