The smaller truck was employed on the applicant’s rural mail contract for four hours a day three days a week, and the contract was for three years from 1934. Counsel submitted that although the applicant had been refused a license by the authority in Wairoa, the work he had done since and the work he had in prospect were such as to warrant the granting of a license for the limited area applied, for. Counsel submitted that it was reasonable that with the amount of work offering the applicant should be allowed to extend his business.

Air. Woodward called the applicant to confirm his submissions. The witness mentioned that he had been in business as a general carrier for 22 years. Cross-examined by Air. Chrisp, the applicant stated that he had continued to take out temporary licenses during the past year until he was stopped, lie was not sure of the number; it might have been 12. He asked for 14 days when applying for each temporary licensee The witness stated that he charged for work on a basis of Is per mile.

The applicant was cross-examined at length regarding his system of charging, the work he had done, and the work in prospect.

The chairman pointed out that it must be shown that there was a need for the service proposed, and it was necessary for the applicant’s books to be examined in order that the position of his business might be ascertained.
