His Honor Mr. Justice Reed gave judgment for the plaintiff in the action of t, Chas. H. Clarke and John Clark (Mr, F. W. Nolan} against Krann Tnngimalun Mirana, and Pine ITrihi, a claim for £1715. Evidence was given by Oh as. Henry
Clarke that he and his brother hud entered into an agreement with the defendants to pmrhasei their property. Coder the agreement, if the transaction was not completed, and the title not given within twelve months, the who e of the plaintiffs’ 1 disbursements were to be relundsxl. Title bad not been givon and the defendants were hotiiied of the pia ritiffs' intention to rescind the contract. To His Honor, Mr. Nolan said the difficulty had arisen through n defee the title.
