Dickson.— Mr. "Nolan for plaintiff, and Mr. Brasaey for defendant. Thos. Mahon deposed : I went to Mr. Dickeon's m February last, and asked him whether he would oblige me with £9 10s. to buy a horse. He gave jit me and I afterwards paid him £5. I j owe him now £4 10s. I told him I had I not the money, but would sell two horses, 1 and pay him, when Mr. Dickson offered' to buy them; He went with a man named Hamilton to see them, about, £ o'clock at night. Hamilton," at MX Dickson's request loosened a mare 1 which Was against plaintiff's protest 1 taken away. The horse was not sold to defendant. The defendant some time ago had asssaulted the plaintiff, ..and the case having been brought before the Resident Magistrate the defendant was fined £2 and costs.
