This Day. , ; t W. Brassey v. H. J. U'Rifir.^.diainf ; £28 for professional services. Mr. Rogan for plaintiff. Judgment for full amount of claim with costs. Thos. Mahon v. J. Dickson.— Mr. "Nolan for plaintiff, and Mr. Brasaey for defendant. Thos. Mahon deposed : I went to Mr. Dickeon's m February last, and asked him whether he would oblige me with £9 10s. to buy a horse. He gave jit me and I afterwards paid him £5. I j owe him now £4 10s. I told him I had I not the money, but would sell two horses, 1 and pay him, when Mr. Dickson offered' to buy them; He went with a man named Hamilton to see them, about, £ o'clock at night. Hamilton," at MX Dickson's request loosened a mare 1 which Was against plaintiff's protest 1 taken away. The horse was not sold to defendant. Plaintiff paid £8 for the !mare.. ;"" '" : ;•- ■' ; ' '•■ 'M*s; Mahdn deposedto Mr. Dickson coming to her husband's' paddock, 1 'and examing the horse by lamplight. Matfon i told him that if he took the) horse, awajg he would hear more of it. : Mrs. Bradley was called but refused to give evidence unless she was paid. , Mr. Dickson deposed that Mahon was willing he should take the . horse, but Mrs. Mahon was unwilling. ' The.mareis heavy m foalj lame, and unfit for work. Mahon was to have paid £1 commission for the loan of the money, Mahon had told him his price, and he had agreed to take the mare. Several people had told witness that she was worth £3 10s. '"", ■ His Worship said there had been no payment and no delivery.' Therefore the defendant had no right to take pos* session of^the mare. Judgment for £8, or the mare to be returned. Coppbll y. P. Lauohran.— Olaim £10, for damage done to the plaintiff's countenance, bones, flesh, and his constitution. The defendant some time ago had asssaulted the plaintiff, ..and the case having been brought before the Resident Magistrate the defendant was fined £2 and costs. Plaintiff now sought personal • dOmpehsa^on, ! i ,/The !' Queen, who had not received any damage,, had got, as fitted, the £2/,but;Ue,r(plaint^) got nothing if a pair of black eyes be excepted. Thecas^ was dismissed.
